Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the Aura Weather application (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and VantarGroup LLC, a company registered in Wyoming, USA ("VantarGroup", "we", "us", or "our"). Your use of the App is also subject to Apple's App Store Terms of Service.

We reserve the right to modify these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

Aura Weather is a weather information application for iOS that provides:

• Current conditions and forecasts based on your GPS location
• Air quality index (AQI) and pollutant data
• Marine conditions including wave height, swell, and sea surface temperature
• Animated precipitation radar imagery
• Ensemble forecast data from leading meteorological models
• Intelligent weather alerts and notifications

The App may be offered as a free download, with optional paid features (such as a premium subscription) available through Apple's in-app purchase system. Pricing and feature availability are subject to change.

3. Weather Data Disclaimer

All weather information provided by Aura Weather is for general informational purposes only. Weather forecasts are inherently uncertain, and conditions can change rapidly and unpredictably.

Do not rely on Aura Weather for life-safety decisions, including but not limited to:

• Aviation, maritime, or commercial transportation decisions
• Emergency preparedness or evacuation decisions
• Outdoor activities in potentially dangerous conditions (mountaineering, open-water swimming, etc.)
• Agricultural, construction, or industrial operational decisions where safety is at risk
• Medical decisions based on environmental conditions

For safety-critical situations, always consult official government meteorological services (such as NOAA, NWS, DWD, or your regional authority) and follow the guidance of local emergency management agencies.

4. License and Permitted Use

Subject to your compliance with these Terms, VantarGroup grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices you own or control, for your personal, non-commercial use.

You may not:

• Copy, modify, or distribute the App or its content
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, sell, or sublicense the App
• Use the App for commercial data collection or resale
• Scrape or systematically extract weather data from our API
• Attempt to gain unauthorized access to our systems or servers
• Use the App in any manner that could damage, disable, or impair our services

5. Intellectual Property

The App, including its design, user interface, graphics, animations, code, and branding (including the "Aura Weather" name and logo), is owned by VantarGroup LLC and is protected by copyright, trademark, and other intellectual property laws.

Weather data displayed in the App is sourced from third-party providers (Open-Meteo, RainViewer, ECMWF, and others) and is subject to their respective terms and licenses. We do not claim ownership of raw meteorological data.

Nothing in these Terms grants you any right to use VantarGroup's trademarks, logos, or other brand features without our prior written consent.

6. Purchases and Subscriptions

Certain features of the App may be available via in-app purchase or subscription, processed by Apple through the App Store. All billing is handled by Apple under Apple's own Terms of Service. VantarGroup does not process or store payment information.

Subscription pricing, billing cycles, and refund policies are governed by Apple's App Store policies. For refund requests, please contact Apple Support directly.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not warrant that: (a) the App will be uninterrupted or error-free; (b) weather data will be accurate, complete, or current; (c) defects will be corrected; or (d) the App is free of viruses or other harmful components.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VANTARGROUP LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

• Inaccurate or incomplete weather forecasts
• Personal injury, property damage, or financial loss resulting from weather-related decisions
• Loss of data or service interruptions
• Any reliance on information provided by the App

IN NO EVENT SHALL VANTARGROUP'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE APP OR SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $10 USD IF NO PAYMENT WAS MADE.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless VantarGroup LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the App in violation of these Terms.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, with or without notice. You may terminate your use of the App at any time by deleting it from your device.

Upon termination, all licenses granted to you under these Terms will immediately cease. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and governing law) shall survive.

11. Third-Party Services and Links

The App relies on third-party data providers including Open-Meteo and RainViewer. These services operate independently and are subject to their own terms of service. We are not responsible for the availability, accuracy, or practices of third-party services.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or your use of the App shall be resolved exclusively in the state or federal courts located in Wyoming, USA. You consent to the personal jurisdiction of such courts.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened intellectual property infringement.

13. Apple-Specific Terms

You acknowledge that these Terms are between you and VantarGroup LLC only, and not with Apple, Inc. Apple is not responsible for the App or its content. Apple has no obligation to provide any maintenance or support services for the App.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation. Any other claims related to the App are VantarGroup's sole responsibility.

Apple is a third-party beneficiary to these Terms and may enforce them against you.

14. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and VantarGroup LLC regarding your use of the App.
